
Welcome to “Spotlight”! One of the many features of the English language is the phrase “family business.” This phrase may refer to a business owned and/or operated by several family members. It can also refer to private matters that are generally handled between family members. In the world of sports these days, “family” and “business” seem to collide. A few weeks ago, NBA legend Shaquille O’Neal’s brand management firm, Authentic Brands Group, opposed a trademark filing on behalf of his son Shaquille O’Neal. NBA star Luka Doncic filed the trademark LUKA DONCIC7 (U.S. Patent and Trademark Office as grounds for rejection) after struggling to obtain a trademark registration for his name. The problem is that his trademark LUKA DONCIC7 was previously obtained with his Doncic’s consent. Doncic seeks to revoke that consent and argue that the registration must be revoked for both these reasons and non-use. Looking into my crystal ball, the winners of these stories are most likely to be lawyers and therapists.
